Preamble
These Terms of Service (the “Terms”) govern the remote sale of products on the website champagnecarbon.com (the “Website”) by CHAMPAGNE CARBON, a French limited liability company with a single shareholder (SARL) with a share capital of €1,555,550, registered with the Trade and Companies Register of Reims under number 819 205 915, whose registered office is located at 38 Rue Pasteur, 51160 Champillon, France (the “Seller”).
Placing an order on the Website implies full and unreserved acceptance, by the customer (the “Customer”), of these Terms, as in force on the date of the order.
Article 1 — Purpose
These Terms govern the rights and obligations of the parties in the context of the online sale of Champagne wines and related products by the Seller to any adult Customer acting as a consumer (i.e. for purposes outside their commercial, industrial, craft or professional activity within the meaning of French consumer law).
The Website is exclusively intended for sales to end consumers. Any sale to a reseller is excluded.

Article 3 — Products and prohibition of sale to minors
3.1 Products offered
The products offered on the Website are Champagne wines and related products, produced or distributed by CHAMPAGNE CARBON. Each product is described in a dedicated product page specifying its essential characteristics, volume, price and service conditions.
The photographs and visuals shown on the Website are intended to be as faithful as possible to the actual products but shall not contractually bind the Seller with respect to minor aspects (vintage, labelling, packaging) that may change.
3.2 Prohibition of sale to minors
In accordance with Article L3342-1 of the French Public Health Code, the sale of alcohol to persons under 18 is strictly prohibited.
By placing an order on the Website, the Customer certifies on their honour that they are at least 18 years old and have the legal capacity to enter into a contract. The Seller reserves the right to request proof of age at any time. An order placed by a minor is null and void. The carrier may request proof of identity at the time of delivery.
3.3 Availability
Offers are subject to availability of stock. In the event of unavailability after an order has been placed, the Customer will be informed as soon as possible and may choose to accept a longer delivery time or cancel the order with full refund.
Article 4 — Prices
Prices are stated in euros (€), including all taxes (VAT) but excluding shipping fees. Prices include French VAT applicable at the time of the order, as well as excise duties and the social security contribution applicable to alcoholic beverages.
Shipping fees are calculated and displayed to the Customer before the final validation of the order, based on the destination, the weight and the number of bottles ordered (see Article 7).
The Seller reserves the right to change prices at any time. However, products are invoiced at the price in force at the time the order is registered.
Article 5 — Orders
5.1 Ordering process
The Customer places an order by selecting products, completing the required information, and validating the cart. The order becomes final after:
- Confirmation of the cart contents by the Customer;
- Express acceptance of these Terms by ticking the dedicated checkbox;
- Validation and payment of the order;
- Confirmation by email from the Seller.
5.2 Order confirmation
A confirmation email is automatically sent to the Customer at the email address provided. This email summarises the subject, price, quantities, shipping fees and execution terms of the order, and serves as proof of the contract concluded between the parties.
5.3 Refusal of orders
The Seller reserves the right to refuse any order that appears abnormal, fraudulent, or in case of a prior dispute with the Customer. The Seller also reserves the right to refuse any order that indicates it may have been placed by or on behalf of a minor.
Article 6 — Payment
6.1 Accepted payment methods
Payment is made online only, by credit card (Carte Bleue, Visa, Mastercard, American Express) or by any other method offered on the Website at the time of the order. Transactions are secured by the payment service providers used by the Website.
6.2 Security
The Customer’s bank details do not pass through the Seller’s servers. They are processed directly by the payment service providers, under secure conditions compliant with the PCI-DSS standard.
6.3 Payment default
In the event of payment default, the Seller reserves the right to suspend or cancel the order. In the event of confirmed fraud, the Seller reserves the right to take any appropriate legal action.
Article 7 — Delivery
7.1 Delivery zones
The Seller delivers to: - Mainland France and Corsica - European Union (member states only)
Deliveries outside the European Union, to French overseas territories (DOM-TOM), and to other overseas territories are not currently offered.
7.2 Delivery times
Estimated delivery times, from dispatch of the order:

These times do not take into account possible stock shortages, carrier delays, exceptional weather conditions or force majeure events (see Article 15).
7.3 Shipping fees
Shipping fees are calculated automatically at the time of the order based on the destination, the weight and the number of bottles. The exact amount is displayed to the Customer before final payment validation.
7.4 Carriers
Deliveries are made by partner carriers, primarily Mail Boxes Etc. (MBE), and occasionally by other operators such as UPS or DHL, depending on the destination and volume.
7.5 Signature on delivery and adult recipient
In accordance with the regulations applicable to the sale of alcohol, the delivery of alcoholic products requires the presence of an adult (at least 18 years old) at the delivery address. The carrier may request proof of identity when handing over the parcel. If no adult is available to receive the parcel, it may be held at a pick-up point or returned to the Seller at the Customer’s expense.
7.6 Late delivery
In the event of delivery delay exceeding 30 days from the announced delivery date, the Customer may, after issuing a formal notice to the Seller that remains unanswered, terminate the contract pursuant to Article L216-2 of the French Consumer Code. A full refund will be issued within 14 days.
Article 8 — Receipt and apparent defects
Upon receipt of the parcel, the Customer must check the apparent condition of the products and the conformity of the delivery to their order. In the event of broken bottles, missing items or any other apparent damage, the Customer must:
- Make precise, dated and signed reservations on the carrier’s delivery slip at the time of delivery;
- Inform the Seller within 3 working days of delivery, by email at jb.prevost@champagnecarbon.com, with supporting photographs.
In the absence of reservations, the products will be deemed compliant and accepted by the Customer.
Article 9 — Right of withdrawal
9.1 Principle
In accordance with Articles L221-18 et seq. of the French Consumer Code, the Customer has a period of 14 calendar days from the receipt of the last product of their order to exercise their right of withdrawal, without having to justify their decision or bear any costs other than those provided in Article 9.3.
9.2 How to exercise the right
The Customer wishing to exercise their right of withdrawal must notify the Seller, before the expiry of the 14-day period, by an unambiguous declaration, at jb.prevost@champagnecarbon.com or by using the standard withdrawal form attached as an appendix to these Terms.
The Customer must then return the products to the Seller, in their original condition, unsealed, unopened, in their original packaging, within 14 days of notification, to the following address:

9.3 Return shipping costs
The direct cost of returning the products is borne exclusively by the Customer. The Seller recommends using a tracked and insured shipping method given the value and fragility of the products.
9.4 Refund
The Seller will refund the Customer for all amounts paid, including the initial delivery costs (on the basis of standard delivery), within a maximum of 14 calendar days from the receipt of the returned products or from the date the Customer provides proof of dispatch of the products, whichever is earlier.
The refund will be made using the same payment method as the original transaction, unless expressly agreed otherwise by the Customer.
9.5 Exceptions to the right of withdrawal
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for products that have been unsealed, opened, consumed or damaged by the Customer after delivery, and which cannot be returned for reasons of hygiene or health protection.
The Seller reserves the right to refuse any refund of products returned in a condition other than that in which they were delivered, or whose original packaging has been damaged.
Article 10 — Legal warranties
Regardless of any commercial warranty granted, the Seller remains bound by the legal warranty of conformity referred to in Articles L217-3 et seq. of the French Consumer Code, and by the warranty against hidden defects referred to in Articles 1641 et seq. of the French Civil Code.
When the Customer exercises their right under the legal warranty of conformity: - They benefit from a 2-year period from the delivery of the goods to act; - They may choose between repair or replacement of the goods, subject to the cost conditions provided for in Article L217-12 of the French Consumer Code; - They are exempt from proving the existence of a non-conformity defect for 24 months after delivery.
The Customer may also choose to invoke the warranty against hidden defects under Article 1641 of the French Civil Code, and may then choose between cancellation of the sale or a reduction of the sale price under Article 1644 of the French Civil Code.

The Seller undertakes to respond to any claim within a reasonable time, and at the latest within 15 working days of its receipt.
Article 12 — Personal data
Personal data collected in connection with the use of the Website and the placing of orders is processed in accordance with Regulation (EU) 2016/679 (GDPR) and French Data Protection Act No. 78-17 of 6 January 1978, as amended.

Article 13 — Intellectual property
All elements of the Website (texts, images, photographs, videos, logos, trademarks, graphics, layouts and source codes) are the exclusive property of the Seller or its partners and are protected by French and international intellectual property law.
Any reproduction, representation, modification, publication, adaptation or exploitation, in whole or in part, of the elements of the Website is strictly prohibited without the prior written authorisation of the Seller, under penalty of legal action.
Article 14 — Force majeure
The performance of the Seller’s obligations under these Terms is suspended in the event of an unforeseen event or force majeure preventing performance, in accordance with Article 1218 of the French Civil Code.
Force majeure events include but are not limited to: strikes, social conflicts, accidents, exceptional weather, blockages of means of transport, pandemics, administrative decisions, and any event qualifying as force majeure under French case law.
Article 15 — Liability
The Seller cannot be held liable for non-performance of the contract in cases of force majeure, fault of the Customer or of a third party, including in the following situations: - Temporary unavailability of the Website; - Improper use of the products by the Customer; - Excessive or inappropriate consumption of the products.
These provisions are without prejudice to the rights of the Customer under the mandatory provisions of the French Consumer Code.
Article 16 — Modification of the Terms
The Seller reserves the right to modify these Terms at any time. The new Terms will apply to any order placed after their publication on the Website, it being understood that the Terms applicable to a given order are those in force on the day the order is registered.
Any substantial modification will be brought to the attention of users with a customer account by any appropriate means, at least 30 days before its entry into force.
Article 17 — Applicable law and jurisdiction
These Terms are governed by French law.
In the event of a dispute, and after an unsuccessful attempt at amicable settlement as provided for in Article 11, the Customer may, at their option, bring the matter before one of the courts having territorial jurisdiction under the French Code of Civil Procedure, or the courts of the place where they resided at the time of the conclusion of the contract or the occurrence of the damaging event, in accordance with Articles R631-3 et seq. of the French Consumer Code.
For Customers residing in another EU member state, jurisdictional rules are governed by Regulation (EU) No. 1215/2012 of 12 December 2012 (“Brussels I bis”).
In case of discrepancy between the French and English versions of these Terms, the French version shall prevail.
Mandatory health notices
Excessive alcohol consumption is harmful to your health. Please drink responsibly.
Drinking alcohol during pregnancy, even in small quantities, can have serious health consequences for the child.
The sale of alcohol to persons under 18 is prohibited.
